What should I do after a slip and fall in Georgia?

  1. Get medical care right away.

Get checked even if you feel fine, and follow your doctor's advice. Keep a record of every visit, bill and symptom. Treatment soon after the fall links your injuries to it.

  2. Report the fall.

Tell the manager, owner or landlord what happened and ask for a copy of any incident report. Write down the name of the person you spoke to.

  3. Photograph the hazard.

Take photos and video of what made you fall, such as a wet floor, a broken step, poor lighting or debris, before anyone cleans it up or repairs it. Photograph your injuries too.

  4. Get witness names.

Ask anyone who saw the fall, or saw the hazard before it, for their name and contact details.

  5. Be careful with the owner's insurer.

Do not give a recorded statement, sign a medical authorization or guess about what caused the fall. The adjuster works for the insurance company.

  6. Talk to a lawyer early.

Security video can be recorded over and hazards get repaired. The consultation is free. Phones answered 24/7.

How do I choose a premises liability lawyer in Georgia?

Choose a Georgia premises liability lawyer on evidence you can check: results in slip and fall and unsafe property cases, readiness for trial and independent reviews. The Scott Pryor Law Group publishes its premises liability results, prepares every case as if it will go to trial, and has 3,200+ Google reviews.

Premises cases often turn on what the owner knew and when. So ask any firm you are considering how soon it will request the property's video, the incident report and the maintenance records. Then check what it tells you against the record.

Confirm each attorney's license in the State Bar of Georgia's member directory. Read a firm's Google reviews as well as the testimonials it picks. Ask whether each result was a verdict or a settlement, and what kind of case it was.

Who is responsible if I slip and fall on someone else's property?

After a slip and fall in Georgia, the property owner may be responsible, and so may the business that runs the property. The Scott Pryor Law Group looks at what they knew or should have known about the hazard, and what they did about it before you fell.

Georgia law puts a duty on the owner. Property owners have a legal obligation to maintain safe conditions for visitors. Your claim turns on whether the owner met it.

Most of these claims are paid by a liability insurer. Businesses buy that insurance for injury claims, so the insurer handles claims like yours all the time. Most people handle one once. The insurer's incentive is to pay as little as it can, especially when it can see you do not have a lawyer.

The answers usually sit in the property's own records: how long a spill was on the floor, whether anyone had reported the broken step, whether the parking lot was lit, and whether staff checked the area. A warning sign, or the lack of one, matters too.

We gather that evidence early. When you hire us, we notify the insurer and ask for the incident report, surveillance video and maintenance records while they still exist. We also collect photos, witness statements and your medical records, and we look at whether anyone else shares the blame.

Our results include an unsafe premises case against a large retailer. Big companies have lawyers and adjusters on their side from the first day. You should have someone on yours.

Can I still recover if I was partly at fault for my fall?

Often, yes. If you are less than 50% at fault, you can still recover damages, reduced by your percentage of fault. O.C.G.A. § 51-12-33 In a Georgia premises liability claim, expect the owner's insurer to argue that you should have seen the hazard. The Scott Pryor Law Group answers that argument with evidence.

Store video that shows you glancing at your phone is the kind of detail an adjuster uses to lower an offer. So is a comment at the scene that you were in a hurry.

The same evidence that proves the hazard also answers the blame: how visible it was, whether there was a warning sign, how long it had been there and whether the owner had time to fix it. A spill no one could see in a dim aisle is a very different case from a wet floor marked with a cone.

Be careful what you say early on. Do not guess about fault when you talk to the manager or the insurer, and do not apologize for falling. Describe what happened and stop there.

If you think you were partly to blame, call anyway. We will look at the facts with you and give you an honest answer about where you stand.

While I'm driven and relentless in pursuing justice, I pride myself on being personable, honest, hardworking, and loyal.

How long do I have to file a premises liability claim in Georgia?

The Scott Pryor Law Group tells Georgia slip and fall victims not to wait for the legal deadline. Victims generally have two years to file a personal injury lawsuit. O.C.G.A. § 9-3-33 The evidence in a premises case can be gone much sooner: hazards get repaired, spills get mopped and security video gets recorded over.

The deadline is for filing a lawsuit, and most injury claims settle before one is needed. But talks with an insurer can run for months. Having a lawyer track the deadline from the start keeps the choice to file in your hands.

Your medical records matter here too. Treatment soon after the fall links your injuries to it and makes it harder for an insurer to blame an earlier condition. An adjuster will point to any long gap before you saw a doctor.

The first weeks are when we ask the owner for its video, incident report and maintenance records, and when witnesses still remember what they saw. Waiting makes each of those harder to get.

If months have already passed, call anyway. We want to hear from you, and we will give you an honest answer about where your claim stands, even a hard one.

How much is a slip and fall case worth in Georgia?

The value of a Georgia slip and fall case depends on your injuries, how they affect your work and daily life, the evidence about the hazard, any shared fault and the insurance available. The Scott Pryor Law Group does not promise a number before it reviews the facts.

A claim can include economic losses, such as medical bills, future treatment and lost wages, and non-economic losses, such as pain and suffering and the loss of things you used to enjoy.

Some injuries take time to show their full effect. That is one reason not to accept an early offer before you know the extent of yours. Once you settle, you cannot go back and claim the costs of a problem that appears later.

Insurers look for reasons to pay less: a gap in treatment, an earlier injury, or an argument that you should have seen the hazard. We value the claim once the extent of your injuries is known, and we answer each argument with records.

Our premises liability results are on the case results page. Every case is different, and no past result tells you what yours is worth.

What evidence do I need after a slip and fall?

After a slip and fall in Georgia, the evidence that matters most shows the hazard and how long it was there: photos, the property's video, the incident report and witness names, along with your medical records. The Scott Pryor Law Group asks for the property's records early, before they are lost.

Questions

Frequently asked questions

What does a premises liability lawyer cost at The Scott Pryor Law Group?

Nothing up front. The consultation is free, and there are no out-of-pocket fees while your case is open. You don't pay unless we win your case. Our fee is a set percentage of what we recover for you, so it depends on the result. Ask about case costs when you schedule your free consultation.

What kinds of premises cases does the firm handle?

We handle slip and fall injuries from wet floors, uneven surfaces and debris; falls on unsafe walkways or stairs, including stairs without handrails; injuries in poorly lit buildings and parking lots; negligent security cases; swimming pool injuries; dog bites; and other dangerous property conditions. If you are not sure your injury fits, call and ask.

What should I say to the property owner's insurance company?

As little as possible until you talk to a lawyer. Report the fall and ask for a copy of the incident report, but do not give a recorded statement, sign a medical authorization or guess about what caused the fall. The adjuster's job is to protect the insurance company. We can take over those calls for you.

Can I bring a claim if I was attacked on a property with poor security?

It can be a premises liability claim. Inadequate security is one of the unsafe conditions these claims cover, and we handle negligent security cases. They look closely at what the owner knew about earlier problems on the property and what it did about them. Call us soon after the attack, while video and incident records still exist.

How long does a slip and fall case take?

It depends on your injuries and on the insurer. A claim usually should not settle until the full extent of your injuries is known. If a lawsuit is filed, our process includes discovery of about 6 to 12 months and mediation about 1 to 2 months after that. A case can settle at any point along the way.

Will my premises liability case go to trial?

Most do not. Injury claims usually settle, and very few go all the way to trial. Insurers weigh whether a firm is ready for court when they decide what to offer, so we prepare every case as if it will go to trial. We advise you on whether to accept or reject any offer.

Another firm turned down my slip and fall case. Should I still call?

Yes. We look at every case individually, and a case one firm passes on may still be one we can take. The call is free, and a real person listens. If we cannot represent you, we will suggest what to do next. Phones answered 24/7.
